Commonly Asked Questions
-
The Federal Circuit Court of Australia and the Family Court of Australia have established a Court list dedicated to deal with parenting and financial cases that have risen as a consequence of the Covid-19 pandemic.
Usually, cases dealing with issues of family violence and risk to the children will receive immediate attention of a Registrar who assesses the needs of the case to have priority listing before a Judge of the Court.
-
Separated parents will find their parenting arrangements most impacted by the Covid-19 restrictions. The lockdowns due to the Covid-19 pandemic are causing practical limitations about how the children will spend time between their parents. For example, while some children may transition between their parents at school, this will be impractical if schools have temporarily moved to online learning due to a lockdown.
Parents should continue to prioritise their children’s best interests and wellbeing. This however does not mean using the covid-19 as an excuse to breach Court orders and stop the children from spending time with the other parent. Parents are encouraged to communicate directly with each other, or through their lawyers, to find a practical solution to these difficulties.
This will depend on the circumstances of each case and the challenges experienced by the particular family. The Court will also consider whether any parent had a “reasonable excuse” to breach court orders in relation to visitations.
-
The Family Court and Federal Circuit Court in Sydney, Parramatta, Wollongong and Newcastle have remained open and all directions and hearings are being conduct via telephone or video links during the lockdown periods.

“Mitchell achieved the best possible outcome when he represented me in two traffic matters that were heard together. I thought that I was in a position where there could be no positive outcome. With Mitchell’s services I am now able to move forward in my life. He showed a sincere interest from the beginning and on the day of the hearing, fought hard to get me an excellent result.”
