Case Study:

The Overlooked Impact of

Workplace Injuries in
High-Risk Jobs

What happened?

In December 2018, our client was working on a construction site installing gutters onto a roof, when the truss he was standing on gave way and he fell more than three metres to the ground. As a result, he severely injured both of his shoulders and bicep and was unable to work due to the injury.

How we helped

Our client contacted Fern Lawyers with little knowledge of how the compensation process worked. With the support of his legal team, we worked together to advise and implement several strategies to maximise compensation and expedite the claims process, running a permanent impairment claim alongside the workers compensation claim to assist with medical expenses and ongoing loss of income.

Going forwards

We were able to secure a lump sum for permanent impairment for over $54,000. But we didn’t stop there. The Fern Lawyers team are also helping him secure ongoing funding to assist with medical expenses and loss of income. Working tirelessly to achieve the best outcome for the client, we are confident that we will continue to secure further funds to help him recover from the injury.

Questions

What is a physical injury at work?

A physical injury refers to any harm to your body that occurs during your employment. This includes fractures, sprains, dislocations, crush injuries, repetitive strain, or even pain-related issues like insomnia or digestive complications from medication.

Who pays for workers compensation?

Your employer’s insurance. All NSW employers are legally required to hold workers compensation insurance. Once approved, the insurer covers weekly income payments, medical treatment, and other recovery expenses.

What happens if I can’t return to my old job?
Workers compensation may support you with rehab, upskilling or redeployment into a new role suited to your abilities. We can help you understand your options and advocate for a long-term recovery plan.
NSW workers compensation laws provide for government-funded legal support, meaning you don’t pay us out of pocket for our advice. We apply for funding on your behalf.
Do I need a Certificate of Capacity?
Yes. This certificate, issued by your GP, outlines your diagnosis and capacity for work. It’s essential for managing your claim and ensuring your care team, employer, and insurer are aligned in your recovery plan.
